NJ-ACEP was successful, however, prior to this hearing in the removal of the "exclusive contracting" provision out of this S-1285. That provision would have required hospital-based specialties with exclusive contracts with the hospital to participate in the same health plan networks as the hospital. With the help of Physicians for Fair Coverage in D.C. and partner with ACEP, we obtained a legal opinion that provided that this was not legally permissible and the sponsors removed it. However, the NJHA is trying to achieve this same goal by having its membership sign a pledge that they will implement policies that would ensure that contracted groups participate in the same networks as the hospital. NJ-ACEP and the Access to Care Coalition is obtaining a legal opinion on the Pledge, as well. There has been luke warm response to the NJHA pledge signing by its member hospitals, thus far, however.
